Stake.us Faces Class Action Lawsuit in Alabama Over Alleged Illegal Gambling
Online sweepstakes platform Stake.us is facing legal troubles in Alabama, where a class action lawsuit has been filed against its parent company, Sweepstakes Limited. Filed in federal court on May 2, the lawsuit accuses the platform of offering casino-style games disguised as sweepstakes, allowing users in Alabama to participate in what plaintiffs claim amounts to illegal gambling.
Alabama Family Leads Legal Challenge
The suit is spearheaded by Alabama resident Laura Hall and her underage child, identified as J.C., along with other plaintiffs who allege financial losses resulting from using the platform. They claim that thousands of Alabamians may have similarly been misled. According to the complaint, Stake.us exploits a legal loophole by simulating gambling through a sweepstakes model, reportedly sidestepping the state’s stringent anti-gambling regulations.
Two-Currency System Under Scrutiny
Central to the case is Stake.us’s dual-currency system. Users purchase “Gold Coins” for entertainment, but these purchases come bundled with “Stake Cash,” a virtual currency that can be exchanged for cryptocurrency or gift cards. The plaintiffs argue that this mechanism transforms Stake.us from a sweepstakes platform into an illegal online casino, likening it to the now-banned internet café gambling businesses of the early 2000s.
Over 200 Casino-Style Games Allegedly Offered
Stake.us allegedly features more than 200 games, including virtual slot machines, poker, and other popular casino-style options. The lawsuit claims this violates Alabama laws, which prohibit such gambling activities and do not allow for commercial casinos or a state lottery.
Celebrity Endorsements Add to Controversy
The lawsuit also highlights Stake.us’s marketing tactics, particularly its high-profile partnership with Canadian rapper Drake. The artist frequently promotes the platform, urging fans to engage with it, which plaintiffs argue blurs the line between celebrity endorsement and the promotion of gambling — a problematic issue given that Stake.us insists it does not offer real-money betting.
Alabama’s Strict Gambling Laws Create Legal Tension
Alabama is known for having some of the toughest gambling laws in the country, banning nearly all forms of betting, including online casino games. The plaintiffs argue that by failing to list Alabama as a restricted state, Stake.us knowingly allowed residents to access services that should be off limits under state law.
Part of a Growing Legal Trend
This is the third class action lawsuit filed against Stake.us, with similar cases underway in both California and Illinois. While courts have yet to issue definitive rulings on the legality of sweepstakes-based gaming platforms, the increasing number of legal challenges may signal a shift in how these services are viewed under U.S. law.
The plaintiffs are seeking financial compensation and a permanent injunction that would bar Stake.us from operating in Alabama.
