The father of Xavier Anderson, who died in a DWI accident in 2024, has filed a lawsuit claiming that a property overserved Emily Davis, 25, who was responsible for the crash.
New Lawsuit Targets Property That Served Drinks to Guilty Driver
Davis received a 10-year prison sentence for a Class B Felony. The victim’s father is now suing the casino, alleging it overserved Davis intentionally. Anderson filed his lawsuit with the Platte County Circuit Court, seeking $25,000 in damages for emotional distress, mental anguish, suffering, and expenses, claiming Argosy Casino & Hotel in Riverside, Missouri, and its landlord, were negligent in overserving Davis.
The lawsuit alleges three counts of negligence and carelessness, with no comment yet from the casino. It names PENN Entertainment Inc., GLP Capital, Gaming and Leisure Properties, and Missouri Gaming Company.
During Davis’s trial, evidence showed she was served alcohol between 10 pm and 2 am and left the property at 5 am. Anderson argues the staff should have prevented her from driving under the influence. Anderson’s lawyer, Lee R. Hardee III, stated that they will seek full accountability from the property.
